What does Joint and Several mean in your tenancy agreement?
Where there is to be two or more adult persons living in the property they are normally all listed on the tenancy agreement and the tenancy agreement will say they are “jointly and severally” responsible.
This means that, jointly, these tenants are liable for the payment of all rents and all liabilities falling upon the these tenants during the tenancy, as well as any breach of the Agreement. However, it also means that each individual tenant listed on the tenancy agreement is responsible for payment of ALL rent and all liabilities falling upon the tenant, as well as any breach of the Agreement until all payments have been made in full.
This means that if you are one of two or more adults listed on your tenancy agreement, you need to be very careful if you decide to leave the property and the other person wishes to stay.
If you were to leave and the other person living at the property fails to pay the rent, you too will be responsible for the rent arrears. The best thing to do if you decide that you will leave is to have the tenancy agreement amended and your name removed. If the landlord or letting agent wont do that, maybe they could write a letter stating that you have been relieved of your contractual obligations. You need something from your landlord or agent to say you will not be liable for anything to do with that property and this should include damage, non payment of rent and utility bills.
